With Magplus!, we offer an amazing long-term experience you can enjoy . To achieve an exceptional and personalized experience, we need to know what you like. The safety of your personal data is our priority. We will explain how and why we collect, store, share and use your personal data, as well as showing you the options available to choose when and how you share your personal data.
You will find this information in this Privacy Policy ("Policy").
2. About this Policy
This Policy provides essential information regarding how Magplus! uses your personal data. The Policy applies to all Magplus! and associated services (hereinafter, the "Magplus! Service"). The terms governing the use of the Magplus! Service are defined in our Terms and Conditions of Use (the "Terms and Conditions of Use").
We may develop new services or offer additional services. If these new or additional services modify the way we collect or process your personal data, we will provide you with further information and additional terms or policies. Unless indicated otherwise, these new or additional services shall be subject to this Policy.
The goals of this Policy are:
1. Making sure you understand what personal data we collect about you, why we collect it, and who we share it with;
2. Explaining how we use the personal data you share with us in order to provide you with a great experience when you use the Magplus! Service; and
3. Explaining your rights and options in relation to the personal data we collect and process about you and how we will protect your privacy.

3. Your rights and preferences: We offer choice and control
You may already be aware that new European Union regulations known as the General Data Protection Regulation (GDPR) grants individuals certain rights related to their personal data. Therefore, we have applied additional access and transparency controls in our Privacy Center and Privacy Settings to help users exercise these rights. According to their availability and except where limited by applicable law, the rights granted to individuals are:
• Right of access: the right to be informed and to request access to the personal data about you that we process;
• Right of rectification: the right to request that we correct or update your personal data, when they are inaccurate or incomplete;
• Right to deletion: the right to request that your personal data be deleted;
• Right to restrict: the right to request that we temporarily or permanently stop the processing of all or some of your personal data;
• Right to object:
• the right to object to the processing of your personal data at any time, on grounds related to your particular situation;
• the right to object to your personal data being processed for direct marketing purposes;
• Right to data portability: the right to request a digital copy of your personal data and the right to transmit such data for use in a third-party service; and
• Right not to be subject to automated decision making: the right not to be subject to decisions that are based solely on automated decision-making, which includes the creation of profiles, when the decision may have a legal effect on you or produce a similar important effect.
In order to allow you to exercise these rights easily and register your preferences as to how Magplus! uses your personal data, we will provide access to the following adjustments through the Account Settings page:
• Privacy settings: It allows you to control some of the categories of personal data that we process about you, to access your personal data through the "Download my data" button, and includes a link to the Privacy Center in Magplus!. com, where you can find more information about how Magplus! uses your personal data and what your rights are; and,
• Notifications settings: it allows you to select the communications you receive from Magplus!, manage your publicly available personal data and establish your preferences for shared use.
The Privacy Center allows you to control the way in which Magplus! processes your personal data. It provides information about what happens if you set your settings on the Account Settings page and how to stop receiving certain messages from Magplus! If you receive electronic marketing messages based on your consent or in any other way allowed by the applicable law, you can, at any time, respectively withdraw said consent or declare your objection ("opt-out") at no cost. The electronic marketing messages you receive from Magplus! (for example, those sent via e-mail) will also include a mechanism to stop receiving messages within the message itself (for example, a subscription cancellation link in the e-mails sent).
For more information on the rights of the GDPR described above and about the controls we offer to all Magplus! users, see the "Your rights" section of the Privacy Center. If you have any questions about your privacy, your rights, or how to exercise them, contact our data protection manager through the "Contact us" form in the Privacy Center. We will respond to your application within a reasonable period of time, prior verification of your identity. If you are not satisfied with the way we are using your personal data, you can also contact and file an appeal before the Swedish Data Protection Authority (Datainspektionen) or your local data protection authority.
4. How do we collect your personal data?
We collect your personal data in the following ways:
1. When signing up in the Magplus service!: When you sign up in the Magplus! service, we collect certain personal data, such as your e-mail, date of birth, sex and country, so that you can use the Magplus! service.
2. When using the Magplus! service: When you use the Magplus! service, we collect personal data regarding its use, such as the songs you have listened to and the playlists you have created.
3. Through personal data that allows us to provide additional features: occasionally, you can also provide additional personal data or give us your permission to collect them, so that we can provide, for example, more features. As explained below (see Voluntary Musical Data), we do not collect pictures, the exact location of mobile devices, voice data or contacts in your device without prior consent. You shall change your mind and withdraw your consent at any time.
4. Through third parties: We will receive personal data about you and your third party activity, including advertisers and partners with whom we work to provide the Magplus! service (see article 7 ‘Shared use of your personal data’ below). We will only use these personal data with your prior consent to third parties or Magplus! so that the shared use of data is carried out or, in the event that Magplus! has a legitimate interest to use personal data, to be able to provide the Magplus! service.
We use anonymous and additional information for various purposes including testing our computer systems, research, data analysis, creation of marketing and promotion models, improve the Magplus! service and develop new features within the Magplus! service.

The exact personal data that we will collect depends on the type of Magplus! service plan and whether or not you want to use a third -party service (as defined in the Terms and Conditions of Use such as Facebook) to sign up and use the Magplus! service. In addition to the mobile data we collect to provide the Magplus! service (previously mentioned), you can also give us your consent to collect personal data from your mobile device to access features that will improve your experience with the Magplus! service.
We will not access any of the personal data mentioned below without your prior consent: • Your pictures: If you give us permission to access your pictures or camera, we will only access the images that you specifically select to share with us, as well as the metadata related to those images, such as the type of file and the size of the picture. We will neither explore nor import your photo library or your camera reel. The exact location of your mobile device: if you give us permission to access your exact location, we will be able to access your GPS or Bluetooth to offer the feature of location of the Magplus! service. Note that this does not include your IP address. We use your IP address to determine the non-exact location, for example, the country in which you are, to comply with our license agreements; • Your voice data: If you give us this permission, we can access the voice commands captured through the microphone of your device to allow you to interact with the voice feature of the Magplus! service. Keep in mind that you can deactivate the microphone feature at any time; • Your contacts: If you give us permission to access your contacts, we can access the individual contacts stored on the device to help you find friends who use Magplus!

We can collect these personal data if sign up in a test version, purchase any of our payment subscriptions (as defined in Terms and Conditions of Use) or make other purchases through the Magplus! service. The exact personal data will vary depending on the payment method (for example, directly through your mobile provider or an invoice) but may include information such as: • Name; • Date of birth; • Type of credit or debit card, expiration date and certain digits of your card number; • ZIP Code; • Mobile phone number; • Details of your transaction history; If you decide to pay with an invoice, we will provide your personal data to our payment processors to carry out a credit verification and send you the invoices. |

When you use or interact with the Magplus! service, we use different technologies to process your personal data for several reasons. 7. Shared use of your personal data
We have shown you the different categories of recipients of the personal data collected or generated through the use of the Magplus! service.
Publicly available information
The following personal data will always be publicly available in the Magplus! Service: Your name and/or username, your profile picture, your followers and which accounts you follow in the Magplus! service, recently heard artists and your public playlists.
Personal data you can choose to share
The following personal data will only be shared with the categories of recipients indicated in the following chart if you:
• Decide to use a specific feature of the Magplus! Service when sharing specific personal data is needed for the correct use of said feature, or
• Grant us your permission to share personal data, for example, selecting the appropriate setting in the Magplus! Service.

8. Data retention and deletion
We retain your personal data only for as long as necessary to provide you with the Magplus! Service. and for legitimate and essential business purposes, such as maintaining the performance of the Magplus! Service, making data-driven business decisions about new features and offers, complying with our legal obligations, and resolving disputes. We retain some of your personal data for as long as you are a user of the Magplus! Service. For example, your playlists, your song library, and your account information.
Upon your request, we may delete or anonymize your personal data so that you are not identifiable, unless we are legally able or required to retain certain personal data, including the following cases:
• If there is an unresolved issue related to your account, such as an outstanding credit on your account or an unresolved claim or dispute, we will retain the necessary personal data until the issue is solved;
• Where we are required to retain personal data to comply with our legal, tax, accounting and auditing obligations, we will retain the necessary personal data for the period required by applicable law; and/or
• Where necessary for our legitimate business interests, such as preventing fraud or maintaining the security of our users.
9. Transfer to other countries
Magplus! shares your personal data worldwide with other companies in the Magplus! in order to carry out the activities specified in this Policy, including the companies of the Magplus Group! from the following countries: Germany, Australia, Austria, Belgium, Brazil, Canada, Denmark, Spain, United States, Finland, France, Hong Kong, Italy, Japan, Luxembourg, Mexico, The Netherlands, Poland, United Kingdom, Singapore, Sweden, Switzerland, Taiwan and Turkey. Magplus! may also subcontract the processing or sharing of your personal data with third parties located in countries other than your home country. Your personal data may be subject to privacy laws different from those in your country of residence.
Personal data collected within the European Union and Switzerland, for example, may be transferred to and processed by third parties located in a country outside of the EU and Switzerland. In such cases, Magplus! will guarantee that the transfer of your personal data is carried out in accordance with the applicable privacy laws and, in particular, that the necessary contractual, technical and organizational measures are applied, such as the standard contractual clauses approved by the European Commission.

10. Links
We may display third party advertisements and other contents linked to third party websites. We cannot control or be liable for the privacy practices and content of third parties. If you click on a third party advertisement or link, please understand that you are leaving the Magplus! Service and any personal data you provide will not be covered by this Policy. Please read their privacy policies to find out how they may collect and process your personal data.
11. Protection of your personal data
We are committed to protecting the personal data of our users, by enforcing appropriate technical and organizational measures to help protect the security of your personal data. However, keep in mind that no system is completely secure. We have enforced several policies including pseudonymization, encryption, access and retention policies to protect usersagainst unauthorized access and unnecessary retention of personal data on our systems.
The password protects your user account, so we recommend that you use a unique and strong one, restrict the access to your computer and browser, and log out after using the Magplus! Service.
12. Children
The Magplus! Service is not intended for children under the age of 13. However, in some countries, a stricter age limit may apply under local law. See our Terms and Conditions of Use for more details.
We do not knowingly collect personal data from children under the age of 13 or below the applicable age limit (the "Age Limit"). If you are under the age limit, do not use the Magplus! Service nor provide us with any personal data.
If you are the parent of a child under the age limit and you are aware that your child has provided personal data to Magplus!, please contact us using the "Contact Us" form in the Privacy Center and you may request to exercise your applicable rights detailed in Article 3, 'Your Rights and Preferences: We Provide Choice and Control' of this Policy.
If we discover that we have collected the personal data of a child under the age of 13, we will take reasonable measures to delete such personal data. This may require the deletion of the child’s Magplus! account.
13. Changes to this Privacy Policy
Occasionally, we may modify this Policy.
If we make material changes to this Policy, we will notice you as appropriate, for example, by displaying a prominent notice within the Magplus! Service or by sending you an e-mail. We may notify you in advance.
Therefore, be sure to read any notice carefully.
